This Website Privacy Policy (the “Policy”), together with our Terms of Service, apply to this our online interfaces and properties (e.g. websites and mobile applications) owned and controlled by panc MD. including, but not limited to, the www.pancmd.com or www.panc MDcrm.com website (the “Site”). This Policy describes the ways in which we use and share (1) personal information that users, visitors, and customers (“you” or “your”) provide to us when using the Site, and (2) certain information about you that is automatically collected when you access or use the Site. This Policy also describes certain rights and options that you may have with regard to your personal information.


This Policy does not apply to (1) information collected by us offline, or (2) information collected through any third party (including our affiliates and subsidiaries) and any third party application, website, or content (including advertising) that may link to or be accessible from or on the Site.


Please read this policy carefully to understand how we treat your personal information. If you do not agree with the terms and conditions of this policy, you should not access or use the website. By using, accessing, visiting, or registering with the site, or by submitting your information through it, you consent to this policy and to our collection and sharing of your information in accordance with the terms of this policy.


Protected Health Information


When you set up an account with panc MD MD, you are creating a direct customer relationship with panc MD MD that enables you to access and/or utilize the various functions of the Platform and the Service as a user. As part of that relationship, you provide information to panc MD MD, including but not limited to, your name, email address, shipping address, phone number and certain transactional information, that we do not consider to be "protected health information" or "medical information".


However, in using certain components of the Service, you may also provide certain health or medical information that may be protected under applicable laws. panc MD MD is not a "covered entity" under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, " HIPAA"). One or more of the Labs, Pharmacies or Medical Groups (as defined in our Terms and Conditions) may or may not be a "covered entity" or "business associate" under HIPAA, and panc MD MD may in some cases be a "business associate" of a Pharmacy or Medical Group. It is important to note that HIPAA does not necessarily apply to an entity or person simply because there is health information involved, and HIPAA may not apply to your transactions or communications with panc MD MD, the Medical Groups, the Providers, the Labs, or the Pharmacies. To the extent panc MD MD is deemed a "business associate" however, and solely in its role as a business associate, panc MD MD, may be subject to certain provisions of HIPAA with respect to "protected health information," as defined under HIPAA, that you provide to panc MD MD, the Medical Group or the Providers (" PHI"). In addition, any medical or health information that you provide that is subject to specific protections under applicable state laws (collectively, with PHI, "Protected Information" ), will be used and disclosed only in accordance with such applicable laws. However, any information that does not constitute Protected Information under applicable laws may be used or disclosed in any manner permitted under this Privacy Policy. Protected Information does not include information that has been de-identified in accordance with applicable laws.


By accessing or using any part of the Service, you are agreeing that even if HIPAA does apply to panc MD MD, the Medical Groups, the Providers, the Labs or the Pharmacies, any information that you submit to panc MD MD that is not intended and used solely for the provision of diagnosis and treatment by the Medical Group and Providers, laboratory services by the Labs or prescription fulfillment by the Pharmacies, is not considered Protected Information, and will only be subject to our Privacy Policy and any applicable state laws that govern the privacy and security of such information. For purposes of clarity, information you provide to panc MD MD in order to register and set up an account on the Platform, including name, username, email address, shipping address and phone number, are not considered Protected Information.

Contact Information


When you visit the Site, request our services, or purchase products from us we may ask you for your name, address, telephone number, email address, or other contact details in order to respond to your request or inquiry.


User Account Information


In order to access and use certain features of the Site, you must first complete a registration. When you create an account or register with us, we collect your contact information, other identity information (e.g., age, date of birth), other demographic information (location), username and password, and other registration information, including payment information. Please note that if you sign up to use our service you may be asked to submit photographs of your condition, if applicable, as well as demographic and other information relevant to diagnosis and treatment such as your condition, lifestyle and general medical history (e.g. allergies, other medications). This information is necessary to enable us to provide you the account you have requested and to maintain the account and your profile. You may update your account information by editing the information associated with your account.


Location Information


When you use the Site, we may collect information about your use of the Site, including your interaction with advertising and analytics services on the Site, in order to (a) serve you the content and functionality you request, and (b) maintain the privacy and security of the Site and services. Location information collected may include your Internet Protocol (IP) address or unique device identifier.


Cookies and Similar Technologies


Please see the Cookies and Similar Technologies section of this Policy below. If you choose to disable cookies and similar technologies, some areas and features of the Site may not work properly.


Automated Information


When you visit our Site, we automatically collect information from your browser or your mobile device, which includes the date and time of your visit, your Internet Protocol (IP) address or unique device identifier, domain server, your browser type, cookies and data about which pages you visit in order to allow us to operate and provide the Site and our services. This information is used to understand how you interact with the Site and to provide you with advertising and a more personalized experience. Email Interconnectivity


If you receive email communications from us, we may use certain tools to capture data related to if/when you open our message and if/when you click on any links or banners it contains. Other information collected through this email tracking feature includes: your email address, the date and time of your “click” on the email, a message number, the name of the list from which the message was sent, a tracking URL number, and a destination page. We use this information to enhance our marketing efforts. We do not sell or distribute this information to third parties.


Feedback / Support / Inquiries


If you provide us with feedback or contact us for support or to ask us questions, we will collect your name, address, telephone number, email address, and other information needed to respond to your feedback, or request for support, or to answer your question.


Mailing List


When you sign up for one of our mailing lists, we collect your contact information, including your email address. We will not include you on any mailing list unless you sign up for the mailing list(s). You may request removal from our mailing list(s) and we will remove you from the mailing list(s) within five days of our receipt of your request.


Your Communications


When you communicate with us, we may retain your communications in order to process and respond to them, as well as to improve our services. We may use your email address to communicate with you about our services or send you periodic emails. If at any time you would like to unsubscribe from receiving future emails, you may unsubscribe at the bottom of each email.


Financial and Payment Information


If you choose to purchase goods or services from us, we may collect your name, address, telephone number, bank account number, bank routing information, and other data necessary to process payments, including credit card numbers, security codes, expiration dates, and other related billing information. By submitting your payment card information, you expressly consent to the sharing of your information with third-party payment processers and other third-party services (including but not limited to vendors who provide fraud detection services to us and other third parties).

In addition to the information that we collect from you directly, we may also receive information about you from other sources, including third parties, business partners, our affiliates, or publicly-available sources.

California Residents

If you are a California resident, you have the right to know what personal information we collect, use, disclose or sell about you under the CCPA. Additionally, you have the right to access and delete your personal information.

To exercise these privacy rights and choices, please follow the instructions below:

  • How to request access to your personal information: You may request access to your personal information twice in a 12-month period. To do so, please email us at info@panc MD.md  with the subject heading "California Privacy Rights," or call 1- 888-910-panc MD(3656). In response, we will produce an Access Report detailing the personal information we have collected, disclosed, and/or sold about you. This Access Report will be delivered by mail or electronically at your request. Note, we may not always be able to fully address your request, for example, if it would impact the duty of confidentiality we owe to others, or if we are legally entitled to deal with the request in a different way. Please be aware that not all information sharing is covered by the California Privacy Rights requirements and only information on covered sharing will be included in our response.


  • How to request deletion of your personal information: You may request that we delete the personal information it has collected and/or maintained about you. To do so, please email us at info@panc MD.md, or call 1-888-910-panc MD(3656). Note, we may need to retain certain personal information as permitted by law, such as to complete the transaction for which the personal information was collected, maintain an electronic medical record for a Medical Group or Provider, provide a requested good or service, detect security incidents, protect against malicious, deceptive, fraudulent or illegal activities, comply with legal obligations or to enable solely internal uses that are reasonably aligned with your expectations or lawful within the context in which you provided the information.

We reserve the right to charge a fee where permitted by law, for instance, if your request is manifestly unfounded or excessive. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.


Verification: Please note, we will take steps to verify your identity before fulfilling any of the above requests. If you maintain an account with us, we will verify your identity through existing authentication practices for the account (e.g., login and password). If you are not a registered member, we will verify your identity by matching two or three data points that you provide with data points that we maintain and have determined to be reliable for the purposes of verification (e.g., browser or device ID).


Authorized Agents: Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your or your minor child's personal information. In order to designate an authorized agent to make a request on your behalf,you must provide written proof that you have consented to this designation unless the agent has power of attorney pursuant to California Probate Code sections 4000-4465. You must also verify your identity directly with us by providing a copy of your government issued identification.


Response Timing and Format: If you are a panc MD MD customer with an online account, we will deliver our written response to that account online or via email. If you are not a panc MD MD customer or do not have an online account, we will deliver our written response by mail or electronically, at your preference. The response will also explain the reasons we cannot comply with a request, if applicable. Please note, that if you are submitting a request regarding information you provided to a Medical Group, a Providers, or a Pharmacy, your request should be directed to that entity.


Anti-Discrimination Right: We will not discriminate against you for exercising any of your CCPA rights. But note that some of the functionality and features available to you may change or no longer be available to you upon deletion of your personal information.


We do not and will not sell the personal information of minors under 16 years of age without affirmative authorization.
